I did not know you accrued it while on mat leave. I know you accrue annual leave whilst on maternity leave. If you resign, is that leave balance paid out? Your notice period will follow your employment agreement. On the DOL website, it advised 21 days notice for resigning, or extending maternity leave. You still have to give the same notice period, so if you have to give a months notice you still need to do so, so resign a month before your mat leave is due to finish.

All I did was send them a letter saying that I would no longer be returning to work after my maternity leave which finished on x date.
