What happens after you have maternity leave and then want to take it a 2nd time? You have to work for another straight 12 mos, right? There is a person currently on maternity leave at my work and she is still considering coming back BUT she is already 5mos pregnant so by the time that she *may* come back in January, she'll be 7mos pg!!! What's the point in that?

I was under the understanding you have to be back for 12months before you take some more leave. Have a look on ird's website, that will give you some idea about the maternity leave act.

It depends on whether you meet the criteria - one of which is a minimum of 10hours per week average. First time I took leave I hadnt been working quite 12 months in that job but still qualified for paid leave from IRD, but only 6 months maternity leave (job kept open) from my employer. This time I have been there over 123 months but haven't averaged 10 hours so dont qualify for PPL. It depends on what is in your contract how long you can have, but the money side of it is seperate.
Either way, even if she worked until she was due, she probably wouldnt be entitled to either PPL or maternity leave.

You only need to be working for 6 months from your due date to qualify for 14 weeks paid parental leave.
So technically you could return from maternity 12 weeks pregnant and still qualify.
You have to be with your employer minimum 12 months to qualify for the extra 38 weeks unpaid maternity.
Also depends on what's in her contract, some employers are more accommidating for long serving employees.

I was wondering this myself - not that i am TTC or any where close to it (we haven't decided on Number 4 yet) but going back to work 2 months ago i thought how would i have to wait to get pregnant to be entitled to them keeping my job open and getting maternity leave..

I was sure when I had a chat with HR when I was preggers that she told me you have to have a year between taking maternity leave and the following maternity leave and we were reading an IRD book. I might be wrong since I'm not quite awake but I really remember that.

Think it all depends whether you're talking about paid parental leave or unpaid maternity leave.
There is something about working for 6 months means you're entitled to 26weeks leave? Not sure about the paid leave though?
I agree - IRD website or the Employment one (brain SO not working) will surely have something about it.

Generally, you need to be back at work for 6 months to qualify for 14 weeks unpaid leave, and a year to qualify for the 14 weeks paid leave and 38 weeks unpaid leave. Though as someone else said above, it depends on your work place, some will be willing to negoiate with you if you have been with them for a while.

its 6 months for PPL. I went back to work mid dec 05, then got pregnant again in may, and finished work end of november 06. I rung our HR dept as I was worried about the 12 month thing, but she said it's 6 months, however, I would question the point of retuning to work at 7 months pregnant for a short amount of time, then leaving again. I doubt she will get PPL again, although she may be returning so work extends her unpaid leave for another year? My bosses jave just extended my leave till June next year when Jake turns 3 so we are elegible for free care for him, to help out with costs, as it wasn't worth it for me to go back to work, as we get no subsidies and care for 2 kids would eat up all bar $50 of my wages, so not worth it!
