Does anyone know what legal rights the father has to the child if he leaves. Is there a certain amount of time that he has the definate right to, or is it all done via private agreement, (or through the courts if it goes that way)

Any help would be great.

I think it's normally a private choice adn if one party doesn't like the arrangements thats when it would go to court.

yep thats it - but it pays to get it written up as a legal doc even if you do decide between youselves.

i dont know much but if they are on birth certificate and married i assume they have equal legal rights..but yes i think people normally try to sort it out themselves and then it goes to court if they cant.. in my aunties case he didn't want contact and they told him he would lose access if he didn't see them every once in a while and he didn't want to..it was sad:( 2 years on he still doesn't ...sorry i dont know from personal experience..but someone around here will.

he is a guardian (married and on birth cert!) - and that cant be changed. That continues for you both til bubs is 18!!!! lots of rights and obligations with that - look here

as for custody etc - PM me....Now all covered by the care of children act

BTW do not google guardianship as USA definition is VERY different to NZ!

Thanks Bombshell, that was a really good website. its a lot to digest at the moment, and I am so angry with the situation I don't think i can make any clear decisions yet...but at least i have all the info on hand now when i need it.
