I wondered if anyone may know the answer to my question:
I am currently on a fixed term contract due to end on 30 January, they have offered me the position permamantly and I would like it to start from 1 December. Are there any implications in this? Do we need to just make reference to the fact that this contract replaces any prior agreements? My boss wonders if we need to wait for the fixed term to expire first but I'm sure you wouldn't. Thanks!! |

I'm not an HR person, but I have studied employment law.
From my understanding, you can have the fixed term contract end earlier if replacing with a permanent contract. You will just have to make sure that you sign an amendment to the permanent contract stating that it replaces the fixed-term contract. This happened with me when I was working for a government department. I was offered a permanent position about a couple of months before my fixed-term contract expired, so the permanent contract had an amendment attached to the contract stating that I was ending the fixed-term contract early to start on my permanent one. ------------- http://lilypie.com">

I'm in HR and yes you can. The only problem your is if the job is not budgetted for as a full time position (rather than temporary one). This will only be an issue if the organisation is very large. ------------- http://lilypie.com">

Thanks jaz, it is a tiny company (hence why we don't have HR). Cool, perm contract and big payrise from 1 Dec for me
