Question:

Can we hold back the bond if they don't do the gardens and in the agreement is that they have to look after the gardens???

I would say so. It is part of the agreement. We always make sure the gardens and lawns are perfect before we leave on the assumption that we could lose some of our bond.

I would ring the Tenancy Tribunal to confirm, but would imagine that you could withhold enough of the bond to pay a gardener to come and do them.

yes BUT the tenants don't have to do trees or hedges (and in fact can be held accountable if they DO trim them and damage them) - unless it was specified in the contract.

You can request the bond held back until the problem is corrected, BUT to my understanding, most landlords give the tenants a chance (10 day notice) to fix it themselves. your property manager should be able to tell you more.

you can actually make them tend to the gardens now if you are concerned about it, by insisting the property manager issues a 10day notice. they then have ten days to have the gardens in an acceptable state - partiuculary lawns as it can be a fire hazard.

I'll have a wander past later this afternoon. From recent drives past (i always have a nosey anyway), they seem okay. a little overgrown and perhaps the lawn needs a mow (but in this weather you pretty much need to mow every week), but looks okay. the roses need a trim. but if they are like me with the hedge clippers, you may want to do thi yourself (I hack at everything or spray it will round-up)

Dana yeah up here in Waiouru we are. But we own a house in Palmy that Liz just lives around the corner (like 2 houses) from. It is just a rental for us now as we are saving like mad to build once we are all back together again in Palmy once DH has finished his courses.
