So my PPL has finished and I'm on plain old maternity leave. I had intended to take around 6mos leave in total but things are working better than I had thought, so I told work I could start again in a week from today. HOWEVER they have put my replacement on a fixed term contract and they can't give her the boot until that time is up (end of August) or she finds a job and moves on herself. It's a bit frustrating and obviously just an error on the part of my bosses but I'm wondering is there anything I can do in the meantime (apart from getting them into trouble).....am I entitled for the UEB or similar, given that I'm ready to return to work but my job's not open? -------------  |

I thought that a) you had to give the employer 21 days notice of returning to work
and also b) that your work doesnt have to accept you back early if they have a replacement and you told them you would be gone for 6 months. I might be wrong, would be useful to know lol. ------------- http://lilypie.com">  http://lilypie.com">

Yeah if you tell your work you want 6 months off then you can only come back early by agreement of *all* parties. My friend got caught like that as she asked for 12 months off and then wanted to come back after 6 and couldn't.
It's not fair on the replacement otherwise. -------------

Thats right, I had to give about 3 weeks notice to come back to work & that was on the agreed day anyway.
I guess it depends on your work but they won't want to pay 2 peope & they can not break her contract. What is UEB? is it unemployment benifit? if it is don't think you can get it if you have a partner & if no partner then it would be solo parent benifit. Not sure. |

Like the other girls have said, that you agreed to have 6 months off so your work has done what they need to til you go back, and they dont have to let you go back early. As it is not fair on the person they have employed.
I was lucky with my work, i asked to go back early, and they needed me so i am starting back next Monday. :( I did go in to see them a month ago though to see if it would be ok. Hope you sort something and glad things are going welll.  -------------

Gee that seems a bit weirdo, couldn't everyone do that then, and say to their work they want a year off, they get a 12 month contract person in, then you can decide to change mind and not be able to get job back and get emergency benefit....seems a bit bizaare! -------------

I'm not sure exactly how it works and I have an appointment on Friday. For starters, my DH is a SAHD and I have been on PPL for the baby. So the PPL has expired and that means we have no income (save for WFF and accommodation supplement). Secondly, I don't qualify for UEB (unemployment benefit) because I can't look for full-time, permanent work - because I don't want to turn in my original job. Work can't re-employ me until the replacement leaves. So somewhere between all that I probably qualify. ------------- |

it will because none of you are working Teresa why you can get a benefit as they aren't going to see you without any income coming in. Be a total kettle of fish if your Dh was working then you wouldn't be able to get the benefit. ------------- http://lilypie.com">

Yep it is a loophole, kinda cool! but involves getting used to a low standard of living. I'm just glad I found it now, not in two months' time
