Surrogacy has been the subject of much philosophical and political dispute over the years. But it is absolutely essential in a variety of situations in which a woman who desires a family is unable to carry the pregnancy or give birth herself. These include cancer survivors, women with congenital problems of the uterus, and women with problems as common as fibroids. Typically, the intended parents are closely involved with the surrogate throughout the entire pregnancy, and are even present at the birth. I think, that surrogacy—when treated responsibly and with the respect it deserves—is a vital, necessary alternative for all parties involved. I would like to hear your opinion about surrogacy. Why is it banned in most countries?

For many people, having a child is the ultimate dream. Sharing their love and raising a family can truly make their lifetime picture complete. Unfortunately, though, for some, the inability to have children can be extremely heartbreaking and devastating to their future plans. The good news is that by using the services of a surrogate mother, these couples and individuals can still have the children that they desire, oftentimes with gene characteristics from one or both parents. In its most basic sense, a surrogate mother is used for the purpose of carrying and giving birth to a child for another person or couple when these individuals are unable to conceive and/or carry a child on their own in the natural manner. There are a number of both medical and legal issues that are associated with the concept of surrogacy. These tend to be complex on many levels, with one key issue being the legality of the surrogacy process, which varies a great deal from one country to another.

Yes, Amanda, you are right! In addition to ensuring that the surrogacy process is being carried out in a safe and legal manner, there are also a number of different ethical issues that are – or should be – considered by the biological parent or parents and the surrogate mother prior to initiating the process. While there are many religious organizations that frown upon the process of surrogacy, this concept is oftentimes the only option for some individuals to start a family. It is for this reason that some highly controversial and key ethical issues be addressed. In a surrogate situation, the gestational mother is the woman who carries the baby to term. This can be a very taxing process both physically and emotionally – and unique in that after the surrogate mother physically carries the baby throughout the pregnancy, she needs to physically and emotionally detach herself from the child once it is born. Because the gestational mother will not likely be the child's primary caretaker, there could be legal questions that arise in terms of what – if any – involvement she will have with the child once born. There are also ethical considerations that are brought to mind in terms of informing the child of his or her surrogate mother, as doing so may have an effect on the child's self-identity.

Yes, unfortunately almost all religious organizations oppose surrogacy. But, after all, many couples take this step for medical reasons, and not because of their whims. In addition to the above issues, there is also the factor of surrogate mother compensation. It is typically expected that the intended parents of the child will reimburse the surrogate mother for her medical and other related expenses. There are also surrogate situations where the individual or couple who are the intended parents will pay a fee to the surrogate mother for carrying their baby. With this in mind, it is thought by some that surrogacy could be thought of as being a luxury that is only available to the wealthy. And in some cases it could even be thought of as pregnancy-for-hire.

In any case, however, the process that allows for a loving individual or parents to have a child of their own can allow intended parents to follow through on their intentions of starting a family. Regardless of any medical or other factors that would otherwise prevent them from being able to do so. Indeed, many religions oppose surrogacy. However, each of us has the right to have our own point of view. For this reason, many couples who have joined the surrogacy program hide this fact from their close relatives. After all, often their older relatives do not support this decision. Although it seems to me that sometimes it’s worth giving up your beliefs and supporting loved ones, doesn’t it?

Surrogacy is a highly controversial and emotionally charged topic that both reflects and has implications for our notions of parenthood and family. There are clearly serious ethical issues stemming from the potential exploitation of women in poorer countries, and the dangers of treating children like commodities. While some countries recognise the surrogate as the legal parent, others allocate parenthood to the commissioning parents from the moment of birth. If the child does return home with the commissioning parents, the authorities in that home country must decide whether to give effect to the agreement that took place overseas. And allow them to become the legal parents in their home jurisdiction. In most countries, the wellbeing of the child comes first. This means that authorities are often forced to accept the results of the arrangement.

Yes, surrogacy can provide the joy of a longed-for child, but at the same time it opens the door for the exploitation of the most vulnerable. As surrogacy gains in popularity, these legal and ethical dilemmas will only become more pressing. Countries such as France, Germany, Italy, Spain, Portugal and Bulgaria prohibit all forms of surrogacy. In countries including the UK, Ireland, Denmark and Belgium, surrogacy is allowed where the surrogate mother is not paid, or only paid for reasonable expenses. Paying the mother a fee (known as commercial surrogacy) is prohibited. Commercial surrogacy is legal in some US states, and countries including India, Russia and Ukraine. People who want to be parents may go abroad if their home country does not allow surrogacy, or if they cannot find a surrogate. However, even here, the laws may vary.

Countries popular with parents for surrogacy arrangements are the US, Ukraine and Russia. Mexico and Georgia are also among the countries described as possibilities for surrogacy arrangements. Costs vary significantly from country to country, and also depend on the number of IVF cycles needed, and whether health insurance is required. Previously, many people traveled to India and Thailand. However, after the decision of the local government to ban surrogacy in these countries for foreigners, the situation has changed dramatically. However, this was the right decision, because not all Indian and Thai clinics provided a high level of service. Many of them even forced poor women to become surrogate mothers.

There are no internationally recognised laws for surrogacy. So many parents and children can be left vulnerable - or even stateless. It can take several months to bring a surrogate baby back to the parents' home country. Yes, Thai surrogacy laws dictated that a child's legal mother is its birth mother. Recently Thailand authorities banned surrogate babies from leaving the country with their parents. Hundreds of foreign couples have been affected. A law was also drafted making paid surrogacy a criminal offense in Thailand. Thailand since 2015, has banned foreign people traveling to Thailand, to have commercial surrogacy contract arrangement. Only opposite-sex married couples as Thailand residents are allowed to have a commercial surrogacy contract arrangement. But in the past Thailand was a popular destination for couples seeking surrogate mothers.

Yes, of course, with some diagnoses, only surrogacy can help. I agree with you, the age of a surrogate mother is extremely important. Yes, I joined this forum last year. We are currently considering suitable options. I understand you and support your decision. Especially since the bill ensures regulation of surrogacy in India, prohibiting commercial surrogacy. It allows only altruistic surrogacy to Indian married couple who cannot bear children. The bill says the surrogate mother and the couple that wants to have her child must be close relatives. The bill allows only Indian citizens to avail of surrogacy. Foreigners, non-resident Indians and persons of Indian origin are banned from seeking surrogate mothers in the country.

Oh yes, of course I know about that. It happened a long time ago. But this did not affect our decision, because we rejected this option even before the approval of this bill. I talked about this earlier. Like all international surrogacies in lesser-developed countries, the protections available for intended parents and surrogates are less available — and have led to harmful results. When Indian surrogacy first became a booming industry, there were no regulations in place, and unsafe and unethical practices developed in response. The women who chose to become surrogates in India during this time were subjected to unethical treatment, poor living conditions and exploitation. To keep up with demand from international intended parents, Indian surrogacy agencies effectively ran “baby factories,” where Indian women were forced to live until they gave birth to the intended parents’ babies — with usually no assistance for the family they had left behind while pregnant.

Yes, in addition, the surrogates in India only received a fraction of the expenses that intended parents paid the surrogacy agency. Only $4,000 to $5,000 for compensation. With agencies charging more than double that in total, surrogates were commonly exploited in commercial surrogacy. Their poverty and lack of education drew them back into the surrogacy process over and over again for this financial gain. And their health declined as they effectively became “baby-making machines” year after year. They also did not receive the kind of supportive services they needed for themselves and their family during this emotional journey. That is why I also fully support your decision.

Yes, choosing a country for surrogacy is not very simple. Travel to such poor countries should be abandoned. First of all, because their surrogate mothers are really deprived of their rights. It’s hard to speculate about where the Indian surrogacy laws will go from here. If the recently passed bill is any indication, it seems like surrogacy in India won’t be possible any time soon for international intended parents. This is why many surrogacy professionals recommend working in an area that has regulations aimed to protect those involved. Rather than working with a surrogate in a location that has banned the process outright. It’s not unreasonable to predict that surrogacy will continue in India, even if it’s illegal, putting more intended parents and surrogates at risk than before. In this way, the surrogacy laws in India likely won’t succeed in their goal. And the controversies surrounding Indian surrogacy may not dissipate as quickly as planned. What about America?

Oh, it is so expensive for us. Surely, you know that the cost of surrogacy is sometimes high. And in America, this is an extremely large amount. In addition, surrogacy is allowed there only in some states. Another minus is the presence of additional costs. We chose clinics and countries for a long time, but in the end we turned to a clinic called Biotexcom. The clinic is located in Ukraine, in Kiev. Fortunately, everything went well! They really show excellent results!
