OK so i have read up on the ird website and have got a half pie answer so thought i would ask if someone on OB can clarify it better for me.

I was wondering if we are still entitled to get the family tax credit ($150 a week payments for 8 weeks after bubs is born) if we are recieving ACC payments????

I got this off the website...

Who can't get it
You can't get a parental tax credit if your family income for the full eight weeks includes:

paid parental leave
an income-tested benefit, even if it is suspended
NZ Super
a veteran's pension
a student allowance, or
accident compensation from ACC, a private insurer or your employer, unless you get this for less than three months.

So heres our situation - DH had an accident on saturday which means he wont be at work for around 6-10 weeks and will be getting ACC payments until he goes back to work and bubs is due in 7 weeks SO are we still entitled to PTC????

Hmm, good question. I would think yes - as it is him receiving the payment, not you. Perhaps you should call them and ask?

I just seem to get all sorts of wacky answers when i ring them about things so thought i might come across someone here who has gone through it.
It always goes on DHs income so i hope we are still entitled to it as it was gana go towards our aussie holiday and his accident may mean that we have to push the holiday back a few months again

I know you can apply up to and including your baby's 3 month birthday - so perhaps if you waited just a couple of weeks it would be all ok?

The PTC and PPL are based on you getting it. So getting the PTC means that you aren't getting ACC payments. Thats the way I see it.

I was a puree feeder, forward facing, cot sleeping, pram pushing kind of Mum... and my kids survived!

If you are getting Student Allowance, you are not eligible for PTC. So I conclude that if you are getting ACC, you are also not eligible.

BUT I'm pretty sure that if your DH gets 3 weeks of ACC payments after bubs is born, then you will be eligible for the remaining 5 weeks (of 8 weeeks of PTC).

IRD are pretty full up with IR3 enquiries at the moment and Monday seems to be a busy day. Perhaps try calling again on Thursday-ish.

It says on the website that we can get the PTC as long as he doesnt get any longer than 3 months of ACC payments but i dont know whether that means 3months before Astins born or 3months after or 3months over the time????

from reading that i would say yes.... cause it sounds like he will poss be back at work not long after or before bubs is born anyway.

also if you apply you can have it paid out in a lump sum at the end of the financial year - I think

I think it would mean 3 months from the time of birth seeing as you technically don't qualify for it until the baby pops out anyway?

Family assistance is a bit funny and it could also mean 3mos in that financial year.... now I'm more confused than you were to start with!

PS: If anyone is wondering what his accident was iv just put up a little novel about it in my due in july thread but be warned that it is quite graphic sorry!!
