If anyone has any experiences like this could they plz let me know how they got on??

I purchased something on trade me stating AS IS in the auction but it was also a new product (not listed as new however) and it didnt come with a warranty.

this product is not living up to standards that it should for a new product but also for the price i paid.

Is there anything i can do???

Someone told me to go to the small claims court but can they even do anything in this situation?????

I'd have a read of the consumer guarantees act & see what they say about as is.

Did the auction state the "defect"?

Nope, unless the auction is LISTED as NEW then "as is" stands. If an item is not listed as New, but descibed as new in the auction, this statement descibes the seller's perception of the condition.

are you able to say what the item was on here?

have you emailed the seller? you can contact trademe too. im a bit confused...was it listed as a new product or did the seller say it was a new product or did you think it was from the picture?

I have had trades that have not been ok for various reasons and most of the time its worked out ok as the seller is usually really keen to get good feedback on their auction (because if you leave bad feedback then everyone can see and it puts people off)
