So I know there are some new rules from the Government saying that employers have to be better about offering these... I'm off to discuss my return to work on Monday and want to go back to my job (previously 40 hours +) either three days a week plus one from home, or just three days.

My question is, what do I need to do? Do I need to sort out ideas for them about how it will work/come up with justifications etc or is it their problem.

I SO want this to work, and I truely believe it can, but am nervous about asking (I'm normally the gullible yes person) so any advice would be great.

I'm not sure of the exact wording of the legislation but as I understand it your employer has to give proper consideration to your request and have good reasons for saying no, e.g. you can't do your job from home as in a customer service role.

Saying that I think you need to make a really strong case about how it can benefit your employer as well as you (esp. if you are the first in your company to request flexi hours). Work out the hours/days you want and how it will work for your role - write it all down (maybe in a letter) so you have something to take to your meeting with your work. Stress that you want to come back to work etc, that you have suitable working from home conditions - in short try and anticipate any problems they might come up with and address them.

Good luck - I did the same when I returned to work and my boss was fine with it.

Yes, all they need to do is consider it. They have no obligation to offer you a job unless you are willing to return to the job you left or one with similar hours/responsibilities etc.

So they could turn around and say full time or no time and are within the law to do so. That is the worst case scenario though and most employers are pretty good. Saying that some jobs need to be done full time, so depends on your job and how busy they are really, they might jump at the chance to have someone do less hours if they aren't so busy at the moment.

Try the dept of labour website they may have some good info.

I tried to reduce my hours after I had Jackson... and failed miserably despite the new legislation.
They claimed that by reducing my hours it would cause stress on the other workers.
When I asked about job share they claimed no-one would be interested in working 2 days a week. It was really unfair and I ended up resigning.

I tried "working from home" but they said I would need to have the children in daycare for them to approve it.

I think there is a sheet with guidelines you can download off the dept of labour, I would recommend reading through it and writing down why you think it is going to work etc. That might have helped me had I not been bullied!
