just having a chat with someone and cant find what i am looking for..is there a legal amount of hours/days you are allowed to work before you have to be given time off...is it different if you are on swing/split shifts?

depends on what your contract is etc and whether you are an employee or contractor etc and whether job is in a situation that demands daylight or break times. also you could work 14 days solid then have time off...or take on extra shifts (eg nursing etc) and up to the hospitals to say no more than say three shifts in a certain period etc....
anymore info you can give as to what you are actually looking for? even PM if need be....

Not sure...I know with us we have to have a 10 hour turn-around between shifts, we're restricted with how much and when we can do overtime. The way our rosters work you could potentially end up with 11 days straight if you do shift swap and do overtime on your first day off.
Normally though the max we are rostered to work is 6 days in a row then 2 off on a normally roster or 5 days straight then 3 off on the graveyard roster.
Not sure if that helps.

i just wondered was talking to Janey and her DH is always at work and i said i thought that there was a law saying you had to have a set amount of days time off?so it obviously varies greatly ?

When you say time off, are you talking about sick leave / annual leave etc? Or lunch breaks etc?
It depends on the type of contract i.e. casual, or permanent/fixed term.
I am trained in employment law and work in HR so can help if you can give me a little more info :)

I think it's more talking about a "weekend" - like in a regular job you'd get Sat/Sun off, some people get Sun/Mon off, or Weds/Thurs... like is it law that you have a certain number of days off work in a month? Is that what you mean KA?
I know my friends work at the mines in Aussie, they work 4 weeks on 1 week off, so it kind of evens it out that way...

Yep and you have to have a cetain amount of hours off between full shifts. I remember at work we could have people work 6 days if ok with them but not 7 in a row.

i'm talking working a lot of days in a row...say you work 6 days in a row..do you have to have 2 off then or given two together ?

He gets next weekend off as normal.
But this might be a bit different as he got paid double time to come in for a maintenance shut down its not part of his normal contract.

Oh and actually he is on call so technically he could end up working this weekend as well and then he would work 19 in a row.

Willie does 5 x 13 hour days and 1 x 8 hour day per week and has Sunday off, that's his regular roster, he gets one Sat off every 6-8 weeks and then he has the usual holiday entitlements for annual leave, sick leave etc. as per employment law. He works all public holidays too, except the ones where the refuse tranfer station is closed which are Good Fri, Anzac Day and Xmas Day.
He is subject to very specific laws restricting his driving time tho, not sure exactly what they are but they have to have a set number of breaks, plus a set amount of non-drive time, and then he has to have at least 12 hours between shifts.

There is no legislation anymore around meal breaks, days off etc but working continuously (no breaks) or for long periods without any days off is a health and safety risk and organisations need to identify potential hazards and take steps to minimise them. The Greens are proposing re-introducing legislation around meal breaks.
