Topic: Tenants rights? Posted: 17 August 2010 at 5:49pm |
Just wondering if anyone knows a tenants right for the following:
Our landlord would like to do our bathroom up which is in need to be honest so will be great when it is done.
However.......she has told us it will take up to two weeks. And she can not charge us rent for one week but not both weeks.
I don't mind tagging this onto our holiday so we are away a week anyway, but where are we going to go for a week for $350 with cooking facilities?? We don't have family we can stay with and our friends have no room as they have young families. We were thinking of taking another weeks holiday and staying at DH's parents out of town but I dont want to take two weeks off work and use up all my holidays.
I can't find anything on the internet for our rights.
Does anyone know??

Do you mean kitchen or bathroom? Just because you refer to the bathroom, but then dealing without cooking facilities....?
If it is the bathroom, and it will be unusable for the entire 2 weeks, the LL is usually required to find other accommodation for you, for that period. But you can always ring Tenancy Services and find out for definite what your rights are? Their number is 0800 83 62 62 (0800 TENANCY).

Like Minik8e said I'ld ring the tenancy services and check what your rights are. If the house is unlivable (which having no bathroom I'ld say it is) I would think they either have to provide you with accomodation or charge you no rent for the whole 2 weeks as you would have to find alternative accomodation. But yeah, ring tenancy services and check.

Sorry if I wasn't clear.
The landlord is combining the toilet and bathroom, so willknock down a wall, shift the toilet and shower and bath so we definately can't use for two weeks.
In regards to no cooking facilities, we would have $350 "rent" to find another place for a week (other week we are on holiday) and for $350 per week we won't be able to find an apartment or motel room with cooking facilities to stay in.
My boss at work thinks two weeks is long as well.

I am sure if you found a place for a week and got a quote you could go back to the landlord and ask for that amount. If you have a written quote then they should be understanding. I know you can get fully serviced apartments in the CBD for $420 per week. If you have no luck then go to tenancy services. I am a landlord and wouldn't expect any different. They probably thought the rent would cover a place. Explain short term rentals are a bit more expensive. Hope that helps.
ETA 2 weeks sounds about right. One day for demo, then plumber (ours took 4 days but that was a big project) Then 1- 2 days to install baths and showers etc. New gib 1 day, plaster in this weather could take 2-3 days to dry. Painting 1-2 days, lino or floor covering 1 day for sanding 1 day for laying, Finishing touches such as mirror, towel rails, silicone any tiling etc. 1 day. Due to bathrooms being a small space you can only have one person in there at a time and since tradespeople don't like to wait on others you allow a day for each. So there shouldn't be much change out of 10-14 days if everyone shows up when they are sposed to. Not to mention the countless tea breaks at 65 bucks an hour. Don't get me started on plumbers. lol. I am sure there are some good ones out there but I have yet to find them.

Yes definitely ring and check your rights. What on earth does she expect you to do for the other week? It definitely shouldn't be at your expense and I'd be having a word to her about that. Your house effectively will be unliveable which means you shouldn't have to pay rent. I would be very surprised if you are told that you have to.
When we had to replace the floor and wall in our bathroom we offered to put our tenant up somewhere else but as it was only 3 days she said she would manage fine having a shower at her mothers who lived close by.

It is unreasonable to expect us to just move out for two weeks. And to top it off she wants it done before 31 March to get tax back, but our holiday is booked for the last week of mar beg of april so looks we cant "include" that as one of our weeks away from the house.
I will try to get hold of tenancy tribunal or citizens advice tomorrow and see what they say.

Do you have to be out of the house?
My friend of a friend is in a housing NZ house and had her bathroom re-done, and she just stayed in the house (without bathroom).
Maybe ask if the toilet could be a priority if you stayed in the house for the 2nd week of work?
But I would ring tenency services and see what they suggest.
