hi
im hoping someone out there can help.
ive just finished my 14 weeks paid leave. i approached work 2 weeks ago and asked them if i had any leave, they said i had 4.4 days so i asked if i could take this for the week 14- 21 july. i was told it would be a bit less than usual as its based on my last 12 months earnings. i thought based on my last 12 months earnings (3 months on ppl so approx 9 months of my earnings) i would still get a few hundred to pay the bills.
i checked my bank this mornin and i got paid a grand total of $14.10. Wahoo!
Emailed work to see what on earth theyve done - no reply yet,
Rung Department of labour. Got a man who didnt speak very good english, but he said id need to go back to my employer and find out what sort of calculation they would have done.
I understand that if someone takes their leave at the end of their 12 month maternity leave then it would be next to nothing due to not working for the past 12 months... but not sure what happens when its after the ppl?
p.s im not going back to work now until after my 12month maternity leave

I think that because the PPL is paid by the government, not your employer, they don't include that in their calcs but since you've only been off work for 14 weeks $14 seems very very low.
Can you try calculating? Figure out what you've been paid over the past 12 months (not including PPL) and then divide that by 52 and you should have a rough estimate of what a week of leave is worth.

Yup, calculated that and i should get at LEAST $500?
Then i thought maybe because i had acrued 2-3 of those days WHILE i have been off on the PPL then its not counted? I had at least 2 days owing when i left on the 3 april.
I also wondered if maybe its based on the last 12 months earnings of the current tax year? Cause i only worked 1-3 april this year before going on PPL.
Grrrr!!!! I dont know what im going to do. Ive got a $300 bank loan going out tonight?!

OK so if you had 2-3 days before you left you would have accrued 5.38 day the last 14 weeks.
Take your yearly salary after Tax (so what ever you use to get in your bank) divide that by 52, then divide that by 5 and multiply by 7.38 or 8.38 see what you get.
Unless you worked for peanuts I cant see how it would be $14??

My understanding (how we do it at my work) is that if you had leave in the system before you took the leave, it should be paid at your usual pay rate. It is only the leave accrued since you went on leave that is paid at a lower rate.
4.4 days is probably what you've accured while on you were on leave. In fact, it is less than what a full-timer would accrue...were you working part-time before you went on leave?
The 12 months taken from the date you take the annual leave so yes, it should be based on about 9 months of earnings.

Fiona - are you sure its 4.4 days? because 20days a year / 52 weeks = 0.38days x 14 weeks away is = 5.38 days??
I just spoke with my Payroll person and he said nah it calculated at 12 months earning which inc the 14 weeks they were away with no pay. But he said as an example some one who is earning $12.50 an hour their rate would come down to $8.45 and hour (or there abouts)

Yes my calcs come up with that figure too Roksana but Kaiz231 said she only has 4.4 days owing so I was referring to that specifically.
And yes, like your payroll person said, the 12months is from the time they apply for leave so it includes 14 weeks of no pay and 9 months of pay.
I do payroll at my work and we've just been working with this particular issue and it is certainly a confusing one!

Well i managed to get hold of payrol...
Im not entitled to ANYTHING!
WHY? because i have now chosen to take 12 months maternity leave.
I was supposed to be back at work 14 july, (After my ppl ran out) I was originally going to take that week off as annual leave, and return to work part time as of 21 july.
Since my boss was not flexible with part time hours i advised i wanted to take my 12 months leave, this was AFTER she had approved my leave.
Payroll said they cant pay my leave because who's to say i wont return after my 12mnths.
AND the $14.10? This was an insurance rebate (I work for an insurance company and have insurance with them)

what rubbish?? Its your leave you have accrued! you worked for it...you are entitled to it. Call Dept of labour and ask them if they can do this! I hate when companies think they can S ^#@ YOU OVER!!

Hmmm I personally think that you are entitled
*ducks for cover*
They dont "have" to pay you for your leave until it is due to you (at your rollover date) .. however most companies would pay it to you in advance (as they can always recoup any overpayments when you leave)
They only way they would have to pay you is if you resigned (however they then wouldnt have to hold your job open).

I had annual leave accure whilst on maternity leave - I took the 12months ML - so when i went back i had all this 'full time' leave oweing to me even though I only went back part time... anyway I now have 18 weeks leave oweing LOL - never going to get that!
As for not paying it out - they are correct. because its accured and you tyicnically not working to make it up they do not pay it out until they know a; you are coming back, b. when you leave if youare entitled to it.
Hope that makes sense...

They are only required to pay out the Annual leave that you had oweing when you went on annual leave.
