I got a phone call last night from a photographer who took some professional shots of our family a year or so ago- she has been offered a magazine cover and wanted to use one of our photos so was asking permission. I said fine- we were actually pretty chuffed about it
Now I've just gone to her website and she has actually got 5 different photos from that shoot up in different areas of her site. She never asked permission to use these and although I would have said yes if she had of asked, I'm a bit annoyed that she didn't.
Would you guys say anything? If so, what?
I hate confrontation so in all likelihood I'll just leave it but it just seems a bit wrong to use images of someone elses children to advertise your business without first asking their permission.

Hmmm it's a tricky one, I think out of courtesy she should have asked you for your permission to use the photos of your family on her website.
Maybe you could ask her, if she has just put them up when you gave her permission for the cover? Or has she put them up previously. Did you sign any kind of contract with her? Maybe there's something in the small print that gives her permission to use them?
If it's bothering you, maybe you could send her an email and ask her to take the photos down, but you're happy for the cover to go ahead.

Yeah, she probably 'owns' the images ya know but I think it would have been courteous to ask you. If you want to check what the law says then ask the citizens advice people, they should be able to help you!

It depends what you signed when she did the shoot. Some photographers make you sighn that the images belong to them and they can actually use it for advertisement competitions ect. Reason why I am put off doing some professional shots.

I would think as she owns the images use of them on her website is pretty normal practice, and I know when booked our wedding photographer we signed copyright of the photos to him, have you not done something similar with your photographer?
Not sure why people are put off by it, in the end these are photographers and using your image is how they make a living. I know photos of my nieces ended up in our photographer's advertising material, he didn't ask permission for their use, as he already had it.

Everyone that I know that's used a professional photographer has signed a contract stating the photographer can use the images as they own them.... sorry if that's the case and you're not happy about it

Your photographer will own the copyright of the images so you don't really have anything to complain about I'm afraid.
I discovered my wedding photos all over the venue website, I think they are still there now. They would have asked our photographers if they could use them - nothing to do with us. They were published in a magazine first though (with an interview with me) so I'm not bothered at all.
ETA - maybe look at it from a different angle! Be really proud that your kids are obviously gorgeous enough to be used as promotional material!

i know with pixie photo they rung and asked if they could use a pic of my son for advertising material then i had to go in and sign a form and then it was just that 1 pic they were allowed to use. maybe it was courtesy on their part in my case or they had forgotten to get me to sign the form in the 1st place lol
