As much as I didn't want to, I think that I am going to need to sort out my custody issues through a lawyer, but I just don't know where to start, and I am worried that i am going to be digging my own grave if i go this way,

I also don't really think i can afford a lawyer, I have no idea how much it would cost.

Why can't things just get better instead of always getting worse.....

Any one been through this and got any advice for me...pls pm me..

Hugs Natalie!

My limited experience in this area is 5 years old now, and I was lucky that Willie never even turned up to court to contest custody so it was pretty simple. You should qualify for legal aid, I did and I just rang the local Family Court to ask them to recommend a lawyer who did legal aid custody stuff. I did have to pay $50 as some sort of establishment cost but my lawyer was good about letting me pay that in installments.

you dont need to pay an application fee for legal aid now. You do have to outline your debts and assets. If there is property the legal fees are repaid from that. If no property then they may require you to make payment of usually $10-$50 per week to cover costs - about 90% of cases are not required to pay anything...it is a grant.

call you local law society or contact the likes of your local court who will give you names of family lawyers in your area who do legal aid. If they dont do legal aid then you will be a private paying client for them as they cant put you onto aid.

check out the courts website...
www.courts.govt.nz and go to family section for more on parenting orders for day to day care (custody) and contact (access). Also ask for the free DVD on parenting through separation from the court or your lawyer and make sure you both watch it!

You can find legal aid lawyers in a list "find a lawyer" off the legal services agency website www.lsa.govt.nz
