    Posted: 06 February 2010 at 9:20pm
I know the minimum wage goes up on the 1st April but just have a query about it and hope someone here can help me

Hubby is currently on min wage - $12.50per hour, now he is in sales so each month they have a target to reach, if the get it he gets a certain % cash in the hand/pay packet. if he doesn't reach his target for the month we get nothing extra.
I was just asking hubby if his pay will go up with the new pay increase and he doesn't think well doesn't think they have to because of the commission

so my question
I thought the minimum wage is the base flat hourly rate?
and the commission is like a bonus on top?
or can they include the bonus/commission as his hourly rate even though he is no guaranteed it every month?

I would think his base wage would have to go up otherwise some months/weeks (whatever period he gets paid in) he would earn less than the legal minimum if he doesn't get the commission.

Best thing to do though is give DOL a ring and ask them about it.

Minimum wage is an hourly rate, his pay legally has to go up to the new amount. Employers are not allowed to pay people less than what they're supposed to!

Comission / bonuses are on top of whatever he gets. They cant include it as it's not a guarunteed income.

My understanding is that legally his minimum wage rate has to increase.
Commission structures can chop and change at any time (at the discretion of the employer) so depending on how they structure that will determine his take-home pay (if he reaches his target).
If that makes sense

*eta: it took me so long to write and post that that I missed MissAngel's post. Snap

Ditto what everyone else has said.

DH gets paid by salary and when I work his hourly rate its less than minimum wage. Without commission we would be screwed, its a real pain with WINZ though.

thanks lady's
thats exactly what I thought, but no being a typical male he thinks he is right

will give the DOL a call on monday just to see.

he gets paid fortnightly so one pay is the 'normal amount' and the second one is usually the commission (well not the one on xmas eve last year or this last pay ) so it makes things difficult at the best of time as the 'off' pay means only enough to just cover the bills - our one on thursday this week we have $40.00 left after the bills and thats not including bus fares or food
