My sister sold her car on trademe on Monday, and now the people that bought it have not picked up the car, have backed out of the trade and have become quite abusive towards my sister. Emails are full of swear words calling her an f'n lier etc. This wouldn't be a problem however they have all her car details, her home and mobile number and her home address.

What I am wanting to know is... can she do anything. I don't think she is worried, but to be honest I am a bit worried about what they might do. I can copy and paste copies of the worst emails to give you an idea later of what is going on.

Isn't there somewhere on TM with rules etc. that you could look at? Also your sister would have a record on TM listing car as sold (I'm not a lawyer but..) wouldn't that me a contract obliging them to carry through with purchase?

My friend recently sold her car on TM and the guy took the car and was suppose to pay the balance to the finance company which he didnt do. he then onsold the car and now my friend is almost $20000 out of pocket! Trade me were really good and said that the auction records can prove it as a legally binding contract if and when it goes to court. I guess though in your sisters case if they are that sort of people how far do you want to push it?

she can complain to TM re the abusive emails etc but if they have backed out of the deal and are getting ugly maybe she is better off agreeing not to sell the car to them and doing it a different way.

Get in touch with TM, and they should try and sort it out, otherwise not sure really, poor her, some traders are really bad, and want so much for free, I have been ripped off alot

oh I should have been more clear, she doesn't want to sell it to them now, but more worried as they have her address.

Below are 2 of the emails, first from the buyer, second from their partner

Its shere I saw what you said in your feed back you are a f'n LIER, thats not the way i did things I did not abuse you and I hung up as after waiting so long you ring me and get demanding about when I am going to do trade,, get you b*tch,. when I mention about the vin number in earlier email you suddenly change your story about only getting 2 e-mails t0o suddendlyy saying you got 3,,

Your a f'ing dishonest a**hole and you only answer us when I placed feed back ,, so f off or you will find the police on your doorstep,.

stay away from us or you will legally regret it,, f'ing dog

if you place back feed back on us you will find yourself in court that a promise..

Excuse me mate this is s's partner and we did send you 4 e-mails in 3 days and when sarah mentioned after you said we only sent 2 that you mentioned the vin number which was not mentioned in the last 2 e-mails it was from the first which means you blatently lied about recieving it.

consider this a formal tresspass notice precluding to trademe, e-mails, phone calls, physical address.

Basically the jist of it is, she sold the car, then emailed them about 1 hour later (on the Monday), between then and Wednesday night they sent 3 emails (though it was 4 she didn't get one till Thurs morning), demanding car details for change of ownership and the buyer gave work phone number for sis to contact her. On Thurs my sis called and she was abused and then hung up on, so I called and asked when we could sort this out. Agreed pick up for Saturday and told her she had been emailed all the information she required for change of ownership and that she didn't require the extra info she wanted (she wanted all my sisters details, and a full owner history!). They also in that time had placed negative feedback on her, she she wrote an explanation about it. Then last night she gets the above 2 emails

Make sure she reports it to TM!!!

I would flag contacting them again and just place no or basic feedback and get TM to deal with it.

I have TM to be really good with complaints like this as I had a similar issue to this last year. I just reported it and didn't place feedback and TM followed it up and placed feedback and banned them for a time.

Talk to trade me and let them sort it out. I'd keep the emails they have sent just in case it goes any further.

I'd agree with everyone else and say she should report it to Trade Me and just ignore the emails. But def keep them handy - TM might be interested in seeing them. I hope things work out OK.

well the membership has now been disabled, not that it means much as was a hotmail address and they can just set up a new one. Has so far not heard from them, though all correspondecne has been after work hours. Hubby is going round tomorrow in case they do turn up however looking at their account before they got disabled, they took their name off and changed their city as well.
