Topic: advice on tenant vs L/Lord rights...     Posted: 14 January 2008 at 10:55am |

we are about to move into a house owned by my friend. The tenants were evicted (given notice) 45 days ago! and they have until 2moro and have only just started moving a few days ago!!! WTF!!! so anyway my gripe is that they have several car wrecks and caravans on the back yard (which they wernt meant to have! which is one of the many reasons they were evicted!) and they are showing no signs of taking the vehicles with them and are the type of people to leave them anyway....
So im really not a happy camper with having old wrecks all over my yard!! (i lOVE tidy pretty yards and gardens so this is filth to me!) ....
What are our rights regarding these wrecks as of wednesday (the house is no longer available to those tenants)??? my mum thinks that by law we have to store these stupid cars for 6 months! and then we are legally allowed to remove them! is that right??? or can we move them straight away??

She can serve them with the 10 days notice. She can also withhold their bond in lieu of them getting rid of the vehicles.
Another option is she can use their bond to pay for the removal of the vehicles.

You can also ask for reduced rent until the vehicles are moved off the site.

Probably a good idea to do that. She can take them to Tenancy Tribunal if she wants to get money out of them for damage and getting rid of the cars and any other cleaning that needs to be done.

well they are officially out! so we went through yesterday and OMFG!!! they have distroyed the place!!! my mate was almost in tears!!! - they ripped out her new carpet and did god knows what with it! , they wrecked the oven of all things!!!, holes in the walls, both garage doors are broken, windows are smashed and all the latches (to close the windows) have been broken off!, lino in kitchen has been riped up, it even doesnt have a toilet seat now!!!??
its fine for us because we are there to do it up but my poor mate!!!
one big thing is that they didnt take the car nor their crusty couches!! nor the WHOLE garage full of crap!!!
and get this! - there were 4 people living in a tiny caravan that had no windows and no doors!!!!! and one of those was a 3 yr old child!! and there was 4 people living on the floor of the garage and then another 6 living in the 3 bedroom house!!! WTF!!!! some people huh!!!!!
 now the cleaning begins!!....
