here is my rant...(might be long)
So I don't know if you remember but over easter my cot broke, and I had heaps of trouble with the store...blah blah blah... anyways the stupid thing broke again this weekend, so DH took it apart and took it back, and guess what, they were so understanding and nice to him no questions asked, they gave us a store credit for the value of the cot...yay
but.....out for a walk on sunday morning, and the wheel fell off the pushchair, and I mean right off, the whole wheel system, bolts and all, try to take it back, and huge trouble in the store. Hubby rung before we went, and yes he was Pi**ed but he was polite, they told him they would call the police if he went in. So we went in anyway, and yes he kept his temper under control. But they are being really nasty about it...
so the whole point about this rant is does anyone know what my rights are.
The push chair is about 5 weeks out of the warranty, but my thing is Ethan is only 7 months, so I haven't used it for a year, I just purchased it before he was born.I had a look at consumer.org, but you have to be a member to ask a question, so if any one is a member can you try please try to find something out for me.... at the moment i have no cot and no push chair....
Why me???????

What store are you getting this stuff from? If it is part of a bigger chain like BabyCity or the Baby Factory I'd be getting in touch with their head office. I'd also check the brand distributor for the pushchair and possibly get in touch with them. I'd phone the store again either this morning or Tuesday - store managers tend to get Sundays and Mondays off (ahhh retail) so you may have just got a surly 2IC? It's a few months out of warranty but the fact that the entire wheel came off would suggest faulty workmanship. The Consumer Guarantees Act states that an item must be fit for its intended purpose. It is reasonable to believe that a stroller would last longer than 7 months and therefore the faulty goods should be covered under the act. ( Link to the Ministry of Consumer Affairs here... Consumer Affairs . I'd mention the Consumer Guarantees Act while talking to the store manager and 'serious safety concerns' and 'will be writing to local newspaper, tv stations, Ministry of Consumer Affairs and telling everyone you know about the faulty goods purchased at this store and the rotten service received. Good Luck. (and let me know the store...I shop in Albany all the time....I don't want to shop here from the description I've read).

Yep, good ol consumers guarantees act is your friend here. Maree is right it has to be "fit for its purpose" and that goes above and beyond warranties. It is reasonable to expect a buggy to last longer than 7 months use. I think it is also reasonable that we purchase these things a few months before we need them as we are an excited impatient lot.
Go back, ask to speak to manager, if you get nowhere with that ask for the name and number of head office and go for it.

What rotten luck!!! agree with above.... throw ina few "safety concerns", going to media (like mentioned above) and keep at them.... possibly go directly to the top as well and dont bother with the store....Pretty sub standard service...
Great new on the cot tho!

Yay for me, I think the threat of fair go sorted them out. The called me at 9.30 this morning and offered to replace the pram, the best thing was the gave me a different one, heaps better, costs about $100 more than the one I had, and didn't charge me the extra.

TBH I no longer buy things from this particular shop because I have had incredibly crap service from them too - and have no fear of naming and shaming them, it's Baby City in Albany.
