My sister has a problem flatmate who refuse to pay for the phone bill even thou she has admitted that the calls were hers. Is there anything she can do to get her to pay the money as the phone account is in my sisters name. She now has a toll bar on it so she can't make the calls to cell phones.

Unfortunately if it is in your sisters name she is responsible for paying it. She should get it changed into joint names. My mate had this at uni and her two flatmates left and she had to foot the phone bill, council tax and whole load of other bills, needless to say she didn't make the same mistake the next year.

Hmmm... I have had a similar thing happen to a friend but I dont think she ended up getting anything out of the painful toll call maker!
Im sure there must be a way though... sorry my brain is a bit fried to come up with anythign good tonight!

Maybe the disputes court thing...can't remember whats its called. Is not like a proper court, just someone hears both sides and decides who has to pay what and if she didn't pay up then bayliffs can be called in.

Disputes Tribunal. There is an application fee (not sure what it is) so it'd have to be worth it
Although if she admits the calls were hers but is just choosing not to pay, I don't think the DT will be any help.

I work for telstraclear, and even if the account is in joint names, the account 'ownership' can only be in one name. Unfortunatly as its in your sisters name there is nothing she can do, id kick the flatty out and get a new one!

I think if you win the other party has to pay the fees (not 100% on that though). My mate took someone to the tribunal over $700, he won and I don't think he had to pay any fees or if he did it was still worth it.

When my mate won the $700 the woman still wouldn't pay and he filled out a form that got bayliffs sent round to her and that all gets lumped onto what they have to pay. Once they've been told to pay up they have to.

disputes tribunal - think the latest fee is around $30 - so worth it if over say $150...???
Id take it out of her bond! make sure she keeps a record of it ready - and kick her out if she doesnt pay it soon!
