I know that some of you work / have worked in HR and I was wondering if any of you know whether if i am made redundant while on maternity leave i am entitled to the usual pay outs i would be if i were in work?
I am a public sector worker and just preparing for the worst following the budget!
Don't want to contact my own work to discuss this, so hoping someone here knows the answer

Can't help you sorry, as I am also very interested to know about this. I've had a quick look at my contract but it doesn't really cover the maternity leave bit!

My friend was made redundant while on maternity leave, her bubba was about 4 months old. As far as I know she got paid out some money, whatever was in her contract. She was rapt as she didnt want to go back to work!

I was made redundant whilst on maternity leave and I got paid out. I worked in HR too, and that is the legal requirement.
I was so happy! I was planning on not returning to work anyway and got a really generous pay out.

You're entitled to all your contractual entitlements. You should be treated exactly the same as if you weren't on maternity leave (i.e consulted with etc).

Good to know, as I don't plan on returning - haha for once I'm hoping restructuring makes me redundant

Did you use up all your annual leave before going on parental leave? If you were still owed some, you may have to try to negotiate to be paid this out at the same rate you were on when you left.

I got made redundant when on maternity leave (I was stoked as I wasn't going back anyway!) In my contract I had a no redundancy payout clause, but they gave me a bonus and a months salary! So yeah, read your contract and see what you are entitled to.

if your job is disestablished then it is different. I worked in HR previously. If you are on maternity leave and during that time they do a restructure and disestablish your role. Legal requirements mean they need to find you a job that is similar to your "previous job duties" or make you redundant. If you are being made redundant then you need to check your contract as to what it states.

I was made redundant whilst on leave and got everything I was entitled to and maybe a bit more, cos I think they felt a bit guilty, but then I did work for a bank so they were good anyway.
My role was disestablished and I was given the option of them helping me find something else or take redundancy, I took the money

disestablishment is when your position has gone, it has been disestablished, redundancy is what they can give you if you have no position with them any more.
There are several things they can do, they can offer you another position, retrain, or pay you out. You can ask for redundancy if they offer you a position that is not on the same site, same kind of hours & work as your current job.
Redundancy all depends on your contract. It is still effective while you are on mat leave.

I have been made redundant a couple of times...& DH job was disestablished a couple of yrs ago.
