Hi,
I purchased a preowned console from EB games a couple of months back. 2 weeks after buying it, it stopped playing games completly nothing would work. I contacted EB games who advised to bring it in and they would replace it.
I took it in. The guy said we dont have any in ChCh but il get one sent from Auckland.
I phoned up 2 days later to ask when id likely recieve replacement and they said 2 WEEKS! Ok, that annoyed me, so i complained. 1 week and a half later they called me as they had a replacement.
I went to the store and the guy took it out of the box, and hello, the front was broken and the xbox didnt go. So once again i walk away with a not going xbox.
They found another replacement a week late, they tested it and gave it to me. Sweet.
Its been around 3 weeks and now this one is faulty as well, theres 3 red flashing lights and it doesnt turn on, this is after about an hour of game play, it starts freezing and then you reset the console and get the red flashing lights.
I am still under warranty with EB games but i no longer wish to have their 'preowned' consoles.
Where do i stand? Can i ask for my money back?
I mean they dont give me a new warranty from when they give me another console, so i can see this happening over and over untill i have no warranty left and then il be screwed!
What should i do?

I think under the consumer rights act you should be entitled to a full refund of the purchase price because they've had their 3 chances and every time they've supplied you with a faulty or broken product - that's not good enough.
I'd be asking for your money back, and within good reason too. Wouldn't bother dealing with them again either, that's not on!!!

I thought so too, i mean i just completed Legal and Compliance at work and it covers the 3 acts and i think they shoould be giving me a refund.

The goods aren't fit for purpose and they have not provided you with a replacement in a suitable timeframe, I'd say you're entitled to a refund.

I'd definitely go back and demand a refund, bring up the 'Consumer Rights Act' and that'll get the wind up their pipe hole. You're in the right here, you're the paying customer!

Firstly, the 3 flashing lights means the Xbox is screwed. Commonly called the '3 rings of death'.
Secondly, yes they should give you your money back. They've had enough chances to repair or replace and that hasn't been a suitable remedy so the only other option is a refund. My friend is a manager of one of the EB's in Chch and that's what she'd do.
It's a shame this has happened so many times for you though, we bought a pre-owned console and it's going great.

I think what your referring to emz is the red ring of death, and thats all four lights are red. This is 3, which i googled and it means hardware failure.
Im going to call them, its the town EB

Ohhh bugger Kandice, we are on to our 5th Xbox  You may not know this but Xbox and EB Games don't have a very good relationship anymore. We were told this by a manager at EB. Basically Xbox aren't covering any EB consoles. BUT in saying that EB games have a duty to cover them under the Act. My suggestion is to ask for a Reconditioned Xbox. Thats what we did with our current one and we've had no problems -yet.

No because when we purchased the original one we got a 2yr warranty from EB games... and we were also covered by Xbox.
They are selling you a faulty product so they have to do something for you.

God, I wish I could just offer you mine! DF can sit for hours playing it! Obviously he's aware of my disdain for the blimmin thing so unfortunetly if it happened to go 'missing' he'd know exactly who to blame
But, yes like all the others, you are entitled to a refund.. thats really not good enough!

Stand your ground get your money back.
When it comes to game console its bet to buy new  I would not buy 2hand due to problems you may encounter.
