Topic: employment law anyone??? Posted: 14 July 2007 at 4:42pm |
Lewis got paid out from his boss when he left. Now, it is supposed to be 8% of his gross wages - well by my calculations (done by adding last week of March gross wages to the last payslip he received at the beginning of the month) Scott (oops, should I say his boss's name on this) has underpaid him by $200. Now before I ring and complain (a lot), is there any reason why the gross wages should be so different (i.e. his from mine)
am i supposed to
1 - deduct time and a half?
2 - deduct any days in lieu he was paid during the time?
no idea? am planning to ring Department of Labour but thought I would see if anyone knew here.

done that, but can't find the info I want. it just seems to be a huge amount to differ by - I'm hoping that I'm right and he's wrong.

I think under the law it's actually 6%? I could be wrong about that, but try calculating it on 6% and see how you get on.

I think it all depends on when his annual leave anniversary was. If he was due his nextlot of leave before 1 April I think that gets done at 6% and then everything after at 8%. I mightbe wrong and I am sure I saw some examples somewhere. I will try and remember where

nzpiper has it in one If his anniversary was before 1 April, he gets 3 weeks (less any holidays taken into advance) and then 8% of his wages earnt since that time. If his anniversary is after 1 April but before his last day, he gets 4 weeks (less any annual leave already taken) plus 8% of his wages accrued since his anniversary date.

It gets kind of confusing really. If his anniversary was in January, he gets 3 weeks holiday (from Jan 06 to Jan 07) plus 8% of his gross wages since Jan. And follows on the same vein. All depends on his anniversary date.

the dol said that because his anniversary date is october - it would be 8% of his gross wages.
