All I did was send them a letter saying that I would no longer be returning to work after my maternity leave which finished on x date. I resigned a few months before my leave was up so I had tons of notice.

Make sure its after your 14weeks paid maternity leave otherwise those payments will stop

You still have to give the same notice period, so if you have to give a months notice you still need to do so, so resign a month before your mat leave is due to finish.

Crazy Cass is right, don't do it during the 14 week period or you'll loose your payments, if you were only taking the 14 weeks you may be able to come to an "agreement" with your employer.

Thanks! I've extended my maternity leave to 18 weeks, so if I did decide to resign I could do it at the 14 week mark.

I had 2 position in 2 different departments when I was pg with DS2 so I took 14 weeks mat leave from the weekday position & resigned at the end of my PPL so after my final payment & went back to my other position.

On the DOL website, it advised 21 days notice for resigning, or extending maternity leave. Definately resigned after ppl payments are finished though, otherwise you have to pay back the IRD.

Your notice period will follow your employment agreement. Your last working day for purpose of calculating your holiday pay will be pushed back to your last working day (or last day of annual leave if you used that before you left).

Sorry to threadjack, but I have a question kind of like this too.

I know you accrue annual leave whilst on maternity leave. If you resign, is that leave balance paid out? Or do you have to return to work to get it?

Should be paid out, just as when you resign under normal circumstances outstanding leave is paid to you.

I did not know you accrued it while on mat leave. I got mind paid out by them when I went on mat leave...I did not ask for it to be done.
