I can see a fight comming on between me and my sis..

I have my mums car until the estate is settled and then im going to sell it...I told sis that i will give her around $3.5k for her half before it sells because she doesnt want to wait....

I told her im selling it to a car yard for a fast sale...

She texted me a few hours ago saying shes looked them up on trademe and they are worth 3k more than the car yard will give us..

I said to her "yes but there is 3 PAGES! full of these cars so why would someone buy one privately with no warranty when they could buy one for the same price from a dealer on TM and get the warranty"...

And the biggest thing of all is that the car has been in a reasonably big accident (fixed up all good as new but still accident none the less)..

I dont want to give her more than 3.5k then sell it for less bcos i know she wont pay me back the difference AND i will have to keep the car up to standard, legal etc while i wait for AGES for it to sell on TM for what she wants for it..and thats if it does sell at all......

Am i right in just selling it to a dealer and giving her her share??? or should i wait it out on TM??

I'd be inclined to put it on trademe and just see what happens for a couple of weeks. How can that hurt really? And hey if you get a better price why not? For a couple of hundy it wouldn't matter to me, but for a couple of thousand, its enough to consider.

But I do come from a family that has brought and sold many second hand cars. That side of thing doesn't bother me. A car having been in an accident doesn't bother me so long as the repair work is up to scratch.

ETA: you could always make a deal with your sis that you could pop it on trademe for a set amount of time and if that doesn't sell it then you'll go to the dealer. Then you aren't stuck around with the car forever and its giving her idea a shot too. But pay her the half you think the dealer will give you and if you sell it on trademe then you can give her the rest of her half share.

Its up to you but if your sister wants it sold on trade me because it will get more there then I would tell her to wait for it to sell then you'll split the proceeds. If she doesn't want to wait then go the car yard route

I think thats a good idea, or give her the 3.5K and if it sells for more give her the extra then. Give it a time limit (say a month or two) and if it doesn't sell then go with the dealer.

yeah i told her that id sell it THEN give her her cut but she said its not fare because i have the car for use...even thought she was very adament that she did not want it at her house which is why i took it...

i have been watching these cars on TM since mum died 2 months ago and they really are not selling in fact NONE have sold so far (the ones with the same kms etc as this one).

im not sure if im being fair to my sis or not??

If your sister reckons she can sell the car for more on TM, let her list it. Your sister has no right to demand you fork out $3.5K till it sells. If she is that concerned about possession of the vehicle, you need to time share it. 2 weeks hers, 2 weeks yours. There is nothing unfair about that arrangement.

What you've suggested sounds fair to me, if she wants more for it get her to list it on TM. Then she'll have to wait for the money.
Otherwise there is the car yard option.
I sold my car on TM it took about 3 goes at listing it, was only worth 3k so not worth trading in or selling through a dealer.

The other option if you have it is to go for you both to go to the car fair and see what you can get for it there and split the proceeds.

And stick a for sale sign on it, I've sold a couple of cars that way.

Put it on TM, at a price she is happy with...if that is ok with you. DON'T give her any money till it is sold & you have the money.

If she wants it sold that way then she has to wait for payment. Then she has no one to blame for anything.

Yeah, I think if she wants money now then you sell the car now to a dealer. If she wants to sell it on TM for "more" then let her list it and do all the work. And if she complains that you have the car for use, drive the car to her house and leave it in her driveway! Then it would be easier for her to have all the people who want to buy it come and see it.

Tell her if she wants to do the sale then she can put it on there....who's the one going to the effort!

Also will the dealer wait & the price might go down when you go back.
